1. Acceptance of Terms & Scope of Agreement
By accessing, browsing, registering, or utilizing any portion of the Kiara Health AI platform, Clinical Decision Support System (CDSS) modules, patient Over-The-Counter (OTC) care guides, or medical educational repositories, you ("User", "Clinician", "Healthcare Professional", "Patient") agree to be bound by these Terms of Service. If you do not accept all terms contained herein, you are expressly prohibited from using this platform.
Under the executive direction of Dr. Satyam Bhavsar, these terms establish the legal parameters, liability boundaries, and operational standards governing professional use of Kiara Health AI.
2. CRITICAL MEDICAL DISCLAIMER & LIMITATION OF CLINICAL LIABILITY
PLEASE READ THIS SECTION CAREFULLY. KIARA HEALTH AI IS A CLINICAL DECISION SUPPORT SYSTEM (CDSS) AND OVER-THE-COUNTER (OTC) CARE GUIDE. IT DOES NOT CONSTITUTE AUTONOMOUS MEDICAL ADVICE, EMERGENCY SERVICES, OR DIRECT ELECTRONIC PRESCRIBING AUTHORITY.
- Dual Clinical & Patient Scope: For healthcare professionals, Kiara Health AI functions strictly as a Clinical Decision Support System (CDSS) for differential diagnosis analysis, clinical guidelines, and medical documentation assistance. For patients, it provides Over-The-Counter (OTC) symptom guidance, home care remedies, and general wellness education. It does not replace in-person physician consultations or issue direct prescription orders to patients.
- Physician Clinical Responsibility: All diagnostic suggestions, differential lists, red-flag alerts, laboratory interpretations, and clinical summaries provided by Kiara Health AI must be independently reviewed and verified by the treating physician. The ultimate legal, ethical, and clinical responsibility for patient care, diagnosis, prescription issuance, and clinical outcomes rests solely with the licensed treating physician.
- No Direct Doctor-Patient Relationship: Use of Kiara Health AI does not establish a formal doctor-patient relationship between Kiara Health AI (or its medical directors, including Dr. Satyam Bhavsar) and any patient evaluated by a user of this software.
- Emergency Disclaimer: Kiara Health AI must not be relied upon as a primary emergency triage protocol during life-threatening acute crises. Patients experiencing severe symptoms (e.g., crushing chest pain, sudden paralysis, respiratory failure) must be immediately transferred to a fully equipped hospital emergency department.
3. Intellectual Property Rights & Acceptable Use
All clinical diagnostic content, proprietary code, database schema, software interfaces, trade dress, logos, and medical monographs hosted on Kiara Health AI are protected under international copyright, trademark, and intellectual property laws.
- Permitted Professional License: Users are granted a non-exclusive, non-transferable, revocable license to access and use the platform for legitimate clinical consultation, medical education, and EHR documentation purposes.
- Prohibited Actions: Users shall not: (a) reverse engineer, decompile, or scrape clinical database content; (b) attempt to bypass authentication or rate limits; (c) use automated bots to harvest medical guidelines; or (d) white-label or resell clinical decision outputs without explicit written authorization from Dr. Satyam Bhavsar and the Kiara Health AI Board.
4. Clinical Decision Support System (CDSS) & Clinical Documentation Terms
Clinicians and users utilizing the CDSS documentation and clinical summary features agree to the following operational terms:
- CDSS vs Electronic Prescribing: Kiara Health AI is a Clinical Decision Support System (CDSS) and clinical documentation tool. It is NOT an autonomous or direct electronic prescribing application (e-Prescribing network). Any draft prescription template, medication recommendation, or SOAP summary produced by the platform is strictly a clinical reference document intended solely for independent professional review.
- Physician Clinical Review & Prescribing Authority: The issuance or authorization of any medical prescription based upon CDSS documentation requires the active, independent review, professional clinical judgment, and signature of a licensed physician possessing lawful prescribing authority in the relevant jurisdiction.
- Patient OTC & Wellness Guidance: For patient users, recommendations are strictly limited to Over-The-Counter (OTC) symptomatic relief, home remedies, dietary lifestyle measures, and educational wellness advice. Patients must never alter or initiate prescription medication without consulting a qualified medical doctor.
- Verification of Dosing Parameters: The attending healthcare practitioner must independently verify all drug dosages, frequencies, patient allergy status, and potential drug-drug contraindications prior to signing or executing any clinical order or prescription document.
- Compliance with Regional Pharmacy & Health Regulations: Clinicians are solely responsible for ensuring that all medical records and documentation adhere to applicable regional, state, and federal health guidelines and pharmacy regulations.
5. Warranties Disclaimer & Limitation of Financial Damages
Kiara Health AI is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular clinical purpose, or non-infringement.
To the maximum extent permitted by applicable law, Kiara Health AI, its medical officers, employees, and affiliates (including Dr. Satyam Bhavsar) shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use or inability to use this platform.
6. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with applicable statutory laws. Any legal disputes or claims arising out of these Terms or platform usage shall be subject to exclusive jurisdiction in designated courts.
